I am looking to buy a handgun that fires metal BB's or pellets. However, the most I've been able to find is ones that hold 17 BBs. I am buying this as a non-lethal defense against dogs (chows and rottweilers) that are let to run loose on my street where I walk my dog (a 6 month old boxer) on a leash. Multiple calls to enforce leash law has gone unanswered.

A hypothetical question. Suppose someone was 302'd (involuntary commitment to a mental hospital) at age 15 by their parents (not by a court) and has had a pristine record ever since. Is that person still permitted to purchase a firearm as an adult, or do they have to get the 302 expunged first?


I was arrested a while ago for possession of marijuana, and have been clean for awhile since. I recently purchased a new handgun from a pawn shop in Kansas. I was delayed but they still sold it to me after the waiting period was over. I have little knowledge of kansas firearm law until now and have no wish to break the law. If it is indeed illegal for it to have been sold to me, how to i get into compliance?


I just reviewed the laws regarding the transportation of firearms in one's vehicle. The regulations regarding concealable handguns are much more restrictive than those for long guns. I know that it is unlawful to possess a loaded weapon of any kind in one's car in the state of CA (unless you have a CCW permit). So my question is this. Is it legal to carry an UNLOADED shotgun in one's backseat and keep ammo in the glove compartment (or anywhere not attached to the gun) in California?
By unloaded I mean no ammo attached to the gun. However, I also meant to imply that the shotgun would not have a trigger lock.
I was aware of being able to keep a shotgun in the trunk, separate from the ammo. I've gone to the range many times. I was just wondering whether or not one could transport an unloaded, uncased and unlocked shotgun WITHIN REACH inside the vehicle with ammo also in the vehicle. Why? In case crime and violence reach a point where it would be better to have it close by rather than not when driving somewhere. It could deter a carjacking or serve as a means of protecting oneself or others from imminent violence.

I live in Idaho and have a concealed weapons permit so i have carried every day for the last 5 years, I miss San Diego and want to return but I have questions about firearms considering i have grown accustomed to having them with me all the time. First the shotgun question I have a shotgun that I sawed off the barrel to 18.5 inches just above legal and have a pistol grip on but i was worried that since I modified the barrel myself it may still be illegal. also can i keep this under the seat of my truck if it is unloaded? Also I had a couple questions about handguns first of all i know you have to lock them in a case while in the cab of my truck, if locked in a case do they need to be unloaded? also do i need to keep the magazines somewhere else, or is in the case ok? If i decide to open carry my pistol do i need to step out of my parked car to remove it from the case and holster it? or can i do that while sitting in the car? And one final question I have a kel-tec .380 which has a belt clip like a pocket knife, can i just clip this to my belt and leave the magazine in my pocket or do I need a physical holster? Oh one more thing when carrying my 9mm in a holster are there any certain parts of the gun that the holster has to cover or does it require a strap? I like the very minimalistic xd subcompact holsters but dont want to be in the wrong.

I know its restrictive but i cant picture myself never carrying again I thought of one more question as well I know you can open carry with a belt holster but what about a shoulder holster? An uncovered shoulder holster is considered open carry in Idaho but then again its the wild west up here





I like shooting and I also would like to teach my children. I know hunting rifles are allowed and can be bought. But what about AIRSOFT (i.e. BB and Pellets) guns? I heard they just passed a law that would allow handguns to be sold. So I'm thinking---of course Airsoft would be legal.

Anyhoot, can any shed some light on this? Can I bring them in and/or have them shipped from America?

I have two handguns I'd like to sell (on consignment/to a licensed FFL dealer) but I've only recently looked at the laws in Michigan and I'm not sure what to do, or if I may have broken any laws.

Handgun #1
I used to live in Texas and received a handgun as a gift there. At least at the time, there was no requirement to register handguns. I moved to Michigan (Wayne county) several years ago and brought it with me. It's just been sitting around and rusting but I could really use the cash now so I looked into selling. I was told by friends here when I moved that I didn't need to, but NOW that I'm looking over Michigan law, I find that handgun registration is the law here! So I'm pretty sure that I need to register this weapon whether I sell it or not but I'm worried that there may be some fines (or worse) for having waited so long to do it. I can't provide a bill of sale or a previous registration card for above reasons.

Handgun #2
I inherited from my Mom's recently deceased fiancé. He had no written will but his other step-son (only other heir) told me he hated guns and that I should have it. I would like to sell this weapon too but am unsure if I need to re-register it first since I'm not the original owner it was registered to. I can't provide a written Will or original registration (haven't found it yet) but can provide a death cert. and I'm sure the step-son would vouch for me if necessary, if that helps at all.

I really want to do this the right way but am unsure how to do it. And I'm also a little concerned about getting a felony or something just for (stupidly) not filling out a form on handgun #1 years ago, so I'm reluctant to ask local law enforcement first. Thanks for your help.


In my opinion, one of the best parts of being American is the ability to utterly despise something that is done by another person, yet respect their right to legally do that thing. However, it seems that many people now are forgetting that feeling, and expecting the law to completely follow their own personal moral code
(Like people who hate guns and want them to be illegal, or people who hate homosexuality and want homosexual marriage to be illegal)


So, in response to these people, can everyone tell me at least one thing that you believe is terrible, but you respect the rights of others to do it anyway?

Mine is owning handguns. As many know, I am a STRONG supporter of gun owner's rights, and have a shotgun to protect my wife and myself. However, I refuse to buy a handgun, because I fell they are much easier to abuse than a rifle or shotgun. However, I respect the rights of those that disagree, and am proud of that fact.

I got my test for a law class I'm taking, and I want to know if I got this right. I think my professor is wrong. Here's the case:

"The accused, Kandola, was charged with manslaughter after he and the deceased, Smith, had been involved in a long and escalating argument. The death occurred when Smith and his friends appeared at the Kandola's home after threatening on the phone to come over and sexually assualt all the women in the house. The police were called after the threatening phone call, but no car was dispatched. Police were called again when Smith and his friends arrived at the house. Again, no car was sent to the house. Smith banged on the door while his friends surrounded the house armed with hockey sticks and what Kandola thought was a rifle. The police were called a third time. The tape from this phone call indicated sounds of hyseterical fear and bedlam as the house, which contained 16 people - including four or five women and two children - was clearly under attack. Kandola got out a handgun, crawled to a window on the top floor, put his arm out the window and fired blindly. He did this, he testified, in order to scare off the attackers. One of the bullets killed Smith."

Criminal Code

Every person who commits manslaughter is guilty of an indictable offense and liable
(a) where a firearm is used in the comission of the offense, to imprisonment for life and to a minimum punishment of imprisonment for a term of four years; and

(b) in any other case, to imprisonment for life.


Self-Defense

Everyone who is unlawfully assaulted without having provoked the assault is justified in repelling force by force if the force he uses is not intended to cause death or griveous bodily harm and is no more than is necessary to enable him to defend himself.

Everyone who is unlawfully assaulted and who causes death or grievous bodily harm in repelling the assault is justified if
(a) he causes it because he believes he may be killed or suffere grievous bodily harm, and

(b) he believes, on reasonable grounds, that he cannot otherwise escape from death or grievous bodily harm.

Based on the case and the code given, I had to decide whether or not a judge would find Kandola guilty of manslaughter in accordance with the criminal code. The question also asked to decide how the judge who was applying the "plain meaning rule" would decide

Plain meaning rule is a rule of statutory interpretation designed to assist judges when encountering ambiguous words in statutes. This rule suggests that words are meant to be read literally and the words in statutes should be assigned their ordinary meaning regardless of how ridiculous the outcome of a case may be as result of doing so

I wrote that Kandola would be found guilty since he wasn't unlawfully assaulted, and my professor wrote on the test, "He wasn't?" Nowhere in the case did it say that he was. I personally would've said not guilty, but the question asked to apply the plain meaning rule and decide

I recently purchased a handgun, brand new, came with a case, lock, etc. It's sitting in my car, unloaded and locked. However my university bans guns on campus. It's in my car, but the car IS parked on campus. It'll be here until I get the chance to go home. What kind of trouble would I be looking at if someone found out? It's a private university as well, so i'm not sure if this is breaking the law, or just a university rule. Thanks.

I was mentally instituted at the ages 13 1/2 & 17 1/2 by my parents, not by law. I was on medication until the age of 19, April 26, 2009. I plan on owning a handgun at the age of 21 after I get my 2 year college degree & become a Bail Enforcement Agent on the year 2011? When I was in high school, my guidance counselor said that all of this is Expunged/Sealed, is this true? If not is there a way that I can have it Expunged/Sealed, maybe by court or with a help of an attorney? Is there a way that I can prove that I am responsible enough & that I'm not a danger to anybody nor myself, which I never was by the way? Ever since I got off of my Meds things were alot better for me, that this is the first I've ever at least thought about going to college because I did hate school, I've been hanging around with people I've known, I've been making new friends & finally asked a girl out to the prom. Plus I have No Criminal Record nor offenses. And would joining up for the NRA help build some kind of reference?

I really want to become either a Bail Enforcement Agent, work for myself, make the world a place & serve my country & don't want my Criminal Justice Degree go into a waste.

I tried to buy ammo with my mom at walmart, this is THEE ONLY TIME I have had trouble. There is this liberal bitch behind the counter, when she asked mom what kind of ammo, mom asked me. I answered to the Blady "WWB .45ACP Bulk Pack", she refuse to sell it calling it a straw purchase because I answered. Mom doesn't know anything about ammo/guns so thats why she asked me. When the Blady refused to sell it because a minor answered, mom said it was for dad, who was busy at the moment, that bitch said he would have to come himself and buy it (you all know how fast 16$ .45ACP goes out of stock).

I explained to her and the manager about the Youth Sized Pink single shot Cricket .22 rifle, and that it is designed for youths, which in itself is a straw purchase and that they were self contradicting in their statements.

They both went as far to LIE to me saying it was federal law, everyone else has no problem showing me a handgun or letting me examine ammunition (even taking it out of the box and viewing/comparing). This frustrates me as .45ACP is SOOOOO expensive and hard to find.

Our rights have been violated; I'm calling in the big guns (NRA and news writer friend) about this new tactic of making me at the mercy a inexperienced liberal to get my ammo.

Is this, buying ammo for someone else (like husband) a federal offense (she said "felony")?

Ok here we go.. I know what the 2nd amendment is. The right to bear arms but with that being said what does that really mean? Does that mean having the right to carry any weapon we want as long as we have the license for it or is there a point when enough is enough? This is what i think. Hunters can own hunting rifles and everyone else can own handguns if they so choose but really there is no need foa a semi automatic rifle or ak47 on the american street unless there is some military action here which is highly unlikely. My point is this: Americans have the right to have guns but there comes a point when enough is enough. I'm 18 and was wondering the age laws on purchasing a handgun from a private seller.





i live in north Carolina and me and my friend wanted to go up to Virgina to some property that his family owns to shoot a lot of guns and go hunting for a couple of days while camping on the property but we just turned 17 last month. i know you cant buy a rifle and shotgun until your 18 but i dont know the rules for driving with guns. i want to bring about 13 guns with me including handguns so his family who lives up there can shoot with us. is it against the law to bring guns with us while we're only 17 driving down there?


I'm not talking about someone with a felony background. I know what happens in that case.

I'm talking about an average joe with nothing in their background but a speeding ticket or two and that's. What happens if he buys a gun and innocently (or on purpose-insert reason here) never gets around to getting a permit to carry it and is pulled over for say, speeding or what not and the cop finds the gun on his person or in his car?

I know state law varies greatly. I also know it depends on the persons background. I'm just wanting to know if a person has a clean back ground and gets busted for carrying a handgun on his/her person and doesn't have a permit. And yes, they own the gun.

Is there a certain law for specific states, or do you need to be on private property, or have a certain amount of land and NOT near any neighbors? I see a lot of youtube videos with people plinking targets right from their decks with handguns and 22 cal. rifles and other weapons. Is that because they are in a HUGE chunk of land and no one can hear them, and its still illegal ?or is that because the state they are in allows you to fire a weapon on your own property as long as you're not near a neighbor? I remember my uncle used to own 10 acres in new york state to go hunting so im assuming if its your property, and not near others, you can do what you want, but i'm positive there are some gun laws involved here. help me out

Oh, that's right. There is that thing called the constitution which has a part called the bill of rights. The second amendment states that "the right of the people to keep and bear Arms, shall not be infringed"

Gun laws only punish those who follow the law. Look at NYC where you basically can't legally carry a pistol around and it cost you about $600 to just own a gun in your own home!!! When they past those laws did the criminals pay the $600 per handgun they owned? Do they register there firearms? I live in the Georgia thank God but that's just an example. I really don't understand the logic. If someone breaks into your home with a gun with the intent to harm you, What are you going to do. You can't call the police they have a gun to your head. Guns are the most effective tool law abiding citizens have to keep peace for themselves and their families. Why, because they are also the tool used by criminals.


Just received an e-mail from a friend that a Airline Pilot has been reinstated to his job after being fired when a pistol he carried discharged and put a hole in the aircraft. No info as to what make hand gun or caliber it was though the pilot was licensed and had attended the federal class to carry it on flights.
I carried a revolver and later a semi auto for over 32 years in law enforcement and removed and holstered it thousands of times and never had one go off. When assigned to evening shifts I along with many of the men and women I worked with would draw and re-holster our weapon dozens of times during the shift of eight hours and never have a discharge.
I say the guy was screwing around with the gun and it went off my friend defends the guy saying that it was a defective holster as declared by his attorney and upheld by the aritrator hearing the case.

Red River the incident took place in 2002 on a US Airways flight from Denver to Charlotte the Captains name is Jim Lagenhahn CBC news has released the information today. I had heard of the incident but forgotten about it until my friend e-mailed the information to me today. The Pilot was also a retired military pilot and I had forgotten that.
I own many, many firearms and worked in a progun department for many years and wish I was still there but got too old to be of any real use.

Not suprised to see that as of this date 10-13-09 nothing about the out come has been in the press.
My friend is a pilot and received his information through a aviation release.
The pilot got a leg up from Homeland Security that maintained the holsters were defective, no information on what holster was in use at the time. If I find out I will share the info with you, sure would not want to get a defective holster and ruin my record of no accidental discharge would you ?

I'm 18 and i always thought you had to be 21 to buy or posses a handgun. But I was reading and i read that i could purchase from a private non licensed dealer. But i also ran across this GUN SHOW LOOPHOLE CLOSING ACT OF 2009 that says "Firearm Transfers - will be done by licensed importers, manufacturers, and dealers only." Does this mean that if this is passed if it hasnt already been passed, i'll have to wait till im 21 to buy a handgun since an 18 year old is not allowed to buy from a licensed dealer?

don't answer if you don't know, and don't tell me to wait until im 21! in 2012 when i am 21 it will be impossible for me to acquire any handgun because of the "ammo stamping" law which will take effect before im 21. it requires all new handguns to have a cereal number engraved in the fireing pin and i doubt manufacturers will make their guns compliant, and if they do the price will be too high for me to afford. i am a responsible 18 year old who has been shooting all my life, i own several guns and want a 1911 style pistol. i wanted to buy a semi completed frame and finish it. i have all the tools and knowledge needed to do this but don't know if i will be able to register it when it is complete. Ca law says that all hanguns must be registered, and you must be 21 to buy a handgun. it also says that an 18 year old can possess and use a hangun, and that you can construct your own gun as long as they comply with all Ca and federal laws. this is very confusing to me???? if i can build the gun legally can i register it???

I live in Indiana, and apparently the law is that you cannot leave your property with your firearm for any reason until you get a carry permit. However, it takes 2-3 months just to get one. So my question is...

If I just want to go to an inside range to try my new handgun, what are the chances that someone actually asks to see my permit? And if I do get caught without it, what are the repercussions?

Bonus question: You can apply for either a "Personal protection" or "Hunting and Target" permit. What's the difference between them?

Criminals will always have guns. You don't have a right to be protected by the police. I don't understand why people take it upon themselves to tell me that I can't have a certain rifle or handgun?? Instead of more laws, why don't we ENFORCE the thousands of existing gun laws? Before you say "what if it was your uncle or son or dad". It was my uncle who was murdered by a criminal with a shotgun as he went to aid one of the gun mans first victims, unarmed. That man was a drug addict, had a restraining order, had felony conviction all disqualifying him from owning a firearm. Since this in 1997 I have been adamantly pro gun and even carry occasionally when necessary.


I never will understand the logic in preventing someone under 21 from buying/owning a handgun "depending on the state" will somehow prevent shootings in this age group? But when your 18 and up you can just as easily buy an AK semi auto rifle or a 12 gauge semi auto shotgun that can maim and kill large groups of people much easier then a typical handgun ever will.

Yes I have heard the handgun is easier to conceal BS.You can just as easily take a guitar case or a large gym bag have the rifle put in and not be alerted by anyone if you casually stroll through a shopping center.And if someone intends to commit a massacre all he has to do is pull the rifle out of the bag and open fire and if he is highly skilled with the rifle he can put a large number of people down with controlled well aimed shots with the rifle.
Even just going on a full on rampage will end up with people dead and police still taking time to respond.

If we trust 18 year olds with rifle's and shotgun's why not handgun's?

Here is the summary of what happened

The victim told deputies the suspects were armed with handguns, wearing a police badge, a Drug Enforcement Agency (DEA) cap and acted like law enforcement. The victim also said they had tied him up.

After tying the victim up, the suspects shot a round from a handgun and threatened the victim. The suspects stole several marijuana plants, the victim's wallet, two firearms and then disabled the victim's phone. The victim was able to get out of the restraints and ran to a neighbors house where he called the sheriff's department. The victim gave a description of the suspects and their vehicle. About 15 minutes later, deputies spotted the suspect vehicle southbound on Highway 101 at the Arata off ramp. Deputies stopped the vehicle and three suspects were detained. Deputies searched the vehicle and located a police badge, DEA hat, masks and marijuana residue. The firearms, victim's wallet and marijuana were not located. 2 of the suspects are convicted felons.

The one with no prior felobies has been charged with robbery, kidnapping, assault with a deadly weapon and conspiracy and is being held on $250,000 bail in the state of California. He has had 2 DUI's in the last 15 years but no other prior arrests. What is the minimum sentance he can expect?


I am an 18 year old college student who is interested in purchasing his first gun in the summer. I am interested in guns and shooting and want to become more familiar with guns and having gun(s) around the house for home defense. Presently my only experience with guns is with my uncle's 12 and 16 gauge shotguns.

Nobody in my family knows much about guns and of course like other gun-ignorant people, are scared of guns. This will make me one of the few people from my California-family who have entered the realm of firearms.

I am wondering three things primarily.
a) What would be the best way for me to prepare and learn about buying and owning guns
b) What kind of gun should I purchase as a good, fairly cheap beginner firearm
c) Does anyone have a good link to specifics about California gun laws?

Mainly, I am wondering what kind of beginner gun ownership courses I should look to take (if any). Is it true that gun shows are better places to buy guns than gun shops?

Also, I am considering now to buy a shotgun (most likely, they seem the cheapest, simplest to maintain and handle) or maybe a Colt 1911 or a Glock model because ammunition is cheaper and I will need a lot of practice. I understand I cannot buy a handgun until I am 21, but I have heard that you can OWN a handgun if you're 18, just not buy one - say if someone buys one and then transfers ownership to you. Is this true?

Folks, my hometown Chicago recently proposed a law banning handguns for which citizens can use firearms to protect themselves, and we all know just how corrupt Chicago can be... Detroit has many gun laws and that's the worst city in the US (maybe the world).


Which brings me back to my point. Why do we still have high crime rates? My mind cannot contemplate why people are still hurting each other.

The reason i ask is because i came across a store the weekend that was offing 3 Hi point C9 Handguns for 359 dollars ,so with taxes it would be around 385 and i do want a C9 but i don't need 3. So my buddy suggested just buy and then trade 2 of them at our local gun store because he trade a c9 there recently for a 145 dollar store credit. So is there any legal issues with me doing this. Because i not trying to break any laws just get more bang for my buck.I know some of you guys hate hi points but the 2 i own have always worked well for me and it some instance performed better the other guns that i own that cost 3 times as much as they cost.


I have read a little into it but the details get a little hairy. This is what I have read so far:
"(1) A person may not wear or carry a dangerous weapon of any kind concealed on or about the person.
(2) A person may not wear or carry a dangerous weapon, chemical mace, pepper mace, or a tear gas device openly with the intent or purpose of injuring an individual in an unlawful manner."

So do this mean it is legal (or an arguable case) to carry a 'weapon' as defined by:
"'Weapon' includes a dirk knife, bowie knife, switchblade knife, star knife, sand-club, metal knuckles, razor, and nunchaku.
(ii) "Weapon" does not include:
1. a handgun; or
2. a penknife without a switchblade."

In short (I guess this would have been easier to ask), could I carry a fixed blade bowie knife in a leather sheathe unconcealed on my belt for self defense with no intent or purpose of injuring an individual in an unlawful manner? I have seen some people do this and I was not sure on the legalities of it.

Oh and the "unlawful manner" part, is there really a "lawful manner" of injuring an individual on purpose? Seems redundant to me.

WASHINGTON – The Supreme Court could ignite a vigorous new fight over state and local gun controls across the nation when it rules on a challenge to Chicago's handgun ban.
The court said Wednesday it will consider a challenge to Chicago's ban, and even gun control supporters believe a victory is likely for gun-rights proponents.
If the court rules that the Second Amendment right to keep and bear arms doesn't allow the city's outright handgun ban, it could lead to legal challenges to less-restrictive laws that limit who may own guns, whether firearms must be registered and even how they must be stored.
The court last year moved in the direction of voiding tough gun control laws when it struck down a prohibition on handguns in the District of Columbia, a city with unique federal status. Now the court will decide whether that ruling should apply to local and state laws as well. The court will hear arguments in the case early next year, and a ruling probably would follow in the spring.
The court has said previously that most, but not all, rights laid out in the Constitution's Bill of Rights serve as checks on state as well as federal restrictions. Separately, 44 state constitutions already enshrine gun rights.
Though faced with potential limits from the high court on their ability to enact laws and regulations in this area, 34 states weighed in on the gun-rights side before the justices agreed to take the case Wednesday, an indication of the enduring strength of the National Rifle Association and its allies.
The gun case was among several the court added to its docket for the term that begins Monday. Others include:
• A challenge to part of a law that makes it a crime to provide financial and other aid to any group designated a terrorist organization.
• A dispute over when new, harsher penalties can be given to sex offenders who don't register with state sex offender databases.

In voiding Washington's handgun ban last year, Justice Antonin Scalia suggested that gun rights, like the right to speech, are limited and that many gun control measures could remain in place.

Theres been talk lately about the Federal Government reviewing Chicago's ban on handguns. Considering that Chicago is one of the most violent cities in America, residents of the city can not protect themselves. Right now the only people in the city of Chicago that have guns are The Corrupt Police Department and the violent criminals who buy and import the weapons illegally. from other cities or though the black market. The ban on handguns only affects regular, everyday people who purchase their guns Legally and follow the law and only want to protect themselves and their families, businesses, etc. Places that have lax gun control laws or no gun control laws at all have lower violent crime rates yet the Empire of Daley still refuses to acknowledge that he is clearly wrong about his gun control law.

Will the federal government next year vote Chicago's Handgun law unconstitutional or will the law stay and Chicago's violence climb higher?
